If you’re a home improvement contractor in NYC or Long Island, you’ve probably signed (or handed over) a contract that looked fine at first… until something went sideways. The reality is, a lot of contractor agreements out there are missing key protections — and that can cost you time, money, or even your reputation.

Here are five clauses that should be in every contract — but often aren’t:

  1. Clear Scope of Work — and What’s Not Included

Most contracts list what you’re going to do. But it’s just as important to spell out what you’re not doing — like permits, inspections, utility upgrades, or surprise mold removal. If it’s not crystal clear, homeowners might assume it’s part of the deal.

  1. Change Orders in Writing, Always

Homeowners love to add things mid-project — a few more outlets here, a backsplash there. If you don’t have a clause saying changes must be approved in writing (and priced accordingly), you’re doing free work before you know it.

  1. Payment Schedule Based on Work Done

Skip the vague payment terms. Tie payments to actual milestones — like demo complete, drywall up, etc. That way, you’re not stuck waiting for a check just because someone’s “on vacation.”

  1. Right to Pause or Walk If You’re Not Paid

If a client falls behind on payments, you should have the right to hit pause or walk away without it turning into a legal mess. A short clause giving you that option can save you from being stuck on a job you’re not getting paid for.

  1. Disputes + Legal Fees

No one wants a fight — but if it happens, your contract should say how disputes get handled (court, mediation, arbitration) and who covers legal fees. Otherwise, even if you’re right, it can cost a fortune to prove it.

A good contract doesn’t just protect you — it helps avoid problems before they start. Whether you’re working in Queens, Brooklyn, Nassau or Suffolk, tightening up your paperwork can save you from a lot of unnecessary stress.
